No motion, no law office

The McMinnville Board of Mayor and Aldermen used silence to reject a request to change the zoning designation for a West Main Street property.

Under consideration was to redesignate 503 W. Main Street from R1 Low Density to C1 Central Commercial. The measure was met with absolute silence from Mayor Ryle Chastain, Vice Mayor Steve Harvey and Aldermen Sally Brock, Keri Morton and Rachel Kirby. No motion was made to bring the item up for consideration, so no vote was taken.

The property is owned by Robin Bain. She requested the change to establish a law office there.

Unlike the board, three neighbors spoke out against the change during a public hearing held prior to the board meeting. Among them was Sarah Cantrell.

“As a homeowner on West Main Street, I have a deep appreciation for the historic character and residential integrity of our neighborhood,” said Cantrell. “It’s one of the reasons my family chose to make our home there. I want to emphasize that my concerns are not about the property owner or the proposed law office. It’s about the long-term consequences for changing this property from R1 residential to C1 commercial.

“This request also raises concerns about spot zoning, changing the designation of one residential property in a way that may be inconsistent with the surrounding neighborhood and the city’s broader plan for land use. Once a property is rezoned commercial, that designation is not necessarily limited to the business proposed today or this evening.  It could remain in place for decades, allowing for future uses very different from what is currently being discussed. It also raises an important question: if we approve commercial zoning for this one property, what objective standard would guide similar requests from other homeowners on West Main Street.

“In conversations with many of my neighbors on West Main Street, who are both here tonight and not here tonight, I’ve heard similar concerns about preserving the residential character of our neighborhood and the precedent this zoning could establish. I appreciation the Planning Commission’s consideration of this matter and its recommendation to you to deny the request. West Main Street is part of McMinnville’s history and generations of homeowners have invested to preserve its character, and I believe we have a responsibility to consider how today’s decisions will shape it for future generations. I respectfully request that the board uphold the Planning Commission’s recommendation and preserve the property’s R1 residential designation.”

Absent were Kara Youngblood and Deitra Dunlap.
